These terms govern the use of this website and the material published on it. By reading, downloading, printing, using a tool, taking a knowledge check or holding a membership account, a user accepts them.

Guidance only

The material on this website is published for general guidance, professional education and practical reference. It is not legal advice, contractual advice, claims advice, or professional advice of any kind on any particular project, contract, dispute, jurisdiction or set of facts, and no relationship of adviser and client arises from its use.

Entitlement, notices, time bars, payment rights, dispute procedures and remedies turn on the wording of the contract in question, the law that governs it, the records, and the facts. A summary of a decided case, a clause commentary, a calculator, a checklist, a template letter or a training module cannot know any of those, and none of them is a substitute for advice from a qualified lawyer, claims consultant, delay analyst, quantity surveyor, contract administrator or other suitably qualified professional instructed on the actual matter.

What this website provides

This website publishes construction news, reported judgments and case commentary, solutions to contractual issues, FIDIC clause guidance, calculators and procedural tools, CPD lessons and knowledge checks, market information, and membership resources. It is written for quantity surveyors, claims consultants, delay analysts, contract administrators, engineers, commercial managers and construction lawyers.

Accuracy and currency

The material is prepared with care and is checked against primary sources. It is still a summary written at a point in time. Law changes, judgments are appealed, standard forms are amended, and a proposition that was sound when written may not be sound when read. Nothing on this website is warranted to be current, complete or applicable to any particular matter, and a user who intends to rely on a point should verify it against the primary source and take advice.

Calculators, tools and templates

Calculators and tools produce a result from the figures entered into them, using a stated method. They do not decide entitlement, they do not read the contract, and they do not check whether the method is the right one for the matter in hand. Template letters and notices are starting points to be adapted to the contract, the facts and the recipient. Responsibility for checking the contract, the figures, the records and the law before any result or draft is used rests with the user.

Ownership and use of the material

SCCSI owns or controls the material on this website, other than material whose source is identified on the page. Judgments and legislation quoted here are public documents and remain so; the commentary, structure, tools and training material around them are not.

A user may read the material, and may print or save it, for their own professional work, study and research. Copying it into a document circulated outside their organisation, republishing it, reselling it, using it to build a competing resource, or systematically extracting it by automated means, all require written permission from SCCSI.

Accounts and membership

A membership account is personal to the individual who holds it. Sign-in details are not to be shared, and access bought for one person is not to be used by a team. SCCSI may suspend or close an account that is shared, that is used to extract material in bulk, or that is used in a way these terms do not permit.

Availability

The website is developing and its content is added to and revised continually. SCCSI may change, replace or withdraw any part of it. No guarantee is given that the website will be available without interruption or that any particular page will remain in place.

Other websites

Where this website links to another, the link is provided because the destination was useful when the link was made. SCCSI does not control those websites and is not responsible for their content, their accuracy or their handling of personal information.

Changes to these terms

These terms will be updated as the website develops. The date at the foot of the page is the date of the current version, and use of the website after that date is acceptance of the version then published.
