East Riding lets three year footway slurry sealing term contract

East Riding of Yorkshire Council has awarded its term service contract for footway slurry sealing to Pronin Ltd of Whitchurch at 2,160,000 pounds excluding value added tax and 2,592,000 pounds including it. The award notice was published on 26 August 2026 at 11:13am under the identifier 081155-2026 and the award is recorded as active.
The initial term runs from 1 October 2026 to 30 September 2029. The notice records the arrangement as an initial three year term with three optional twelve month extensions and gives a maximum extent date of 30 September 2032. A future signature date of 9 September 2026 is scheduled.
The published value does not say what it covers. One figure is given against a contract that can run for three years or for six, and the notice does not state whether 2,160,000 pounds is the initial term or the whole of it. On a term contract that is the difference between 720,000 pounds a year and 360,000 pounds a year, and it changes the rate a bidder has to hold.
What the contractor has to do before it seals anything
The scope on the notice is wider than the surfacing. It covers the design, supply and application of slurry surfacing in footways, the provision of suitable traffic management and pedestrian protection methods, removal of weeds and detritus material before application, siding out of any overhanging vegetation present at site, reinstatement of any ironwork within the footways, and the identification and protection of any statutory undertakers' equipment affected by the works.
Three of those are preparation obligations sitting on the contractor across an authority area rather than a defined site. Weeds, detritus and overhanging vegetation are conditions found on arrival, they vary by street and by season, and none of them can be surveyed in full before the rate is set. Where the ironwork sits and what condition it is in is the same problem. A rate priced against an assumed average is a rate exposed to whatever the actual footway turns out to be.
The specification the notice calls up
The notice states that the contractor is to carry out all works in accordance with the old Design Manual for Roads and Bridges and the Manual of Contract Documents for Highway Works, Volume 1, Specification for Highway Works, and that Series 000 up to and including 5700 apply.
The word old is the notice's own. On a contract capable of running to September 2032 it is worth establishing at the outset which version of the manual the contract actually incorporates and what happens when the specification changes during the term, because a term service contract that names a standard by description rather than by revision is a change control question waiting to be asked.
Three bidders
The notice records three bids received and three at the final stage. One final stage bid came from a small or medium sized enterprise and none from a voluntary, community or social enterprise. The successful contractor is itself recorded as a small or medium sized enterprise, so the single SME bid on the lot is the one that won.
The procurement was run as a below threshold open competition under the Procurement Act 2023 and the notice records it as below threshold. Two reference numbers appear on the record and they do not match: the tender carries the reference CM195 while the award is titled CM190 term service contract for footways slurry sealing. The notice does not explain the difference, and anyone tracing this contract through the council's own records should expect to search both.
The work is classified under construction work and surface work for footpaths, and the delivery area is recorded as the East Riding of Yorkshire. No street list, no annual quantity and no minimum spend is published on the notice, so the volume behind the rate is not on the public record.
