UK Global Healthcare Limited v Secretary of State for Health and Social Care [2026] EWHC 561 (TCC)

The Department of Health and Social Care applied for summary judgment on its counterclaim for 15,350,000 pounds plus interest and to strike out the claim brought by the supplier, UK Global Healthcare, in a dispute over medical supplies. The matter involved outstanding questions, including laboratory testing of the goods.

Mr Justice Constable examined the material and concluded that the case was not suitable for summary determination. There were matters that could not fairly be resolved without a trial, and the application to enter summary judgment on the counterclaim and to strike out the claim was dismissed.

The case shows the limits of summary judgment in a factual dispute over the quality and testing of supplied goods. Where the outcome depends on evidence still to be resolved, the court will let the claim and counterclaim proceed to trial rather than decide them on the papers.

Mr Justice Constable concluded at paragraph 103: "For the reasons given the Application is dismissed".
