Welsh Government starts procurement for A483 Llandeilo and Ffairfach bypass

The Welsh Government has opened the procurement for the A483 Llandeilo and Ffairfach bypass, with a contract that begins as design development and turns into detailed design and construction only if the statutory procedures allow it and the contractor performs. A contract of that length for a single road scheme reflects the conditional structure rather than a twelve year construction programme.

What the practitioner should take from this

On changes during the term, the notice records that the Welsh Government reserves the right to modify the contracts awarded in accordance with section 74 of and schedule 8 to the Procurement Act 2023, including where changes arise through the NEC4 compensation event process or through the materialisation of known risks identified in the tender documentation. Naming the compensation event mechanism in the notice itself is worth reading twice: it signals that ordinary NEC4 compensation events are expected to sit within the reserved modification power rather than to sit outside the published scope.

Conditions of participation on legal and financial capacity and on technical ability are both recorded as being set out in the Wales Construction Procurement Supplier Qualification Questionnaire, which forms part of the tender documentation. The notice records the procurement as particularly suitable for small and medium sized enterprises. Lots are not used, and the justification given for not using them is recorded as not applicable.

What the notice does not do is describe the works. It gives no length, no route, no structures schedule and no traffic case, and none is offered here. Nor does it say what the design development stage is worth on its own, which is the figure a bidder would need in order to price the first stage against the risk that the second never arrives.
