What issues arise when applying liquidated damages to phased or sectional completion?
Each section requires a defined scope, completion date, extension route, certification process and proportionate damages rate. Ambiguity in any one of those elements can prevent the employer from applying the intended remedy.
Treat each section as a separately administered completion obligation within one coordinated project mechanism
State what forms each section, when it must be completed, which events extend that date and what rate follows culpable delay. Analyse knock-on delay by responsibility: contractor delay in an earlier section does not become an employer-risk event merely because it postpones access to later sections. Prevent duplicate recovery, address partial possession and ensure the aggregate rates remain proportionate to the interests protected.
